Selling Your Car Through Our Platform
Offerupbid offers two primary selling options: Car For Cash and Car For Auction. Sellers must provide accurate vehicle information when listing their car. Buyers reserve the right to adjust their offer or refuse the purchase if discrepancies are found upon inspection. Offerupbid does not guarantee that a vehicle will sell or that a buyer’s offer will be honored.
If a seller accepts an offer through Car For Cash or an auction bid, Offerupbid will facilitate the exchange of contact details between the buyer and seller. The transaction is then conducted independently between the parties, and Offerupbid does not assume responsibility for any disputes.
If you choose to sell your car through our marketplace, you acknowledge that:
- The transaction is solely between you and the buyer;
- We do not guarantee offers, nor do we promise the sale of your vehicle;
- Any initial valuation provided is indicative and may be adjusted upon further review.
You must ensure all vehicle details are accurate. Buyers reserve the right to revise offers or decline transactions if discrepancies arise. Once an offer is accepted, payment and vehicle transfer arrangements must be coordinated directly between you and the buyer.
Uploading Photos and Providing Vehicle Information
If you use our Website to sell a vehicle, you warrant that any content, including images (“Content”), you submit is owned by you. By providing Content, you grant us an irrevocable, global, perpetual, royalty-free, sublicensable, and transferable license to use, modify, reproduce, and display the Content. You waive any moral rights associated with the Content.
You confirm that all provided details about your vehicle are accurate and that you have the legal right to sell it. We reserve the right to use, remove, or edit Content at our sole discretion without compensation.
Acceptable Content and Prohibited Submissions
All submitted material must:
- Be truthful, accurate, and complete;
- Reflect genuinely held opinions when applicable;
- Comply with all relevant UK laws and regulations.
You must not submit materials that:
- Contain false, misleading, or fraudulent information;
- Infringe on third-party intellectual property rights;
- Include harmful software, viruses, or other malicious elements;
- Promote illegal activity, discrimination, or defamatory content.
We retain the right to disclose your identity to third parties in cases of intellectual property violations, privacy breaches, or fraudulent activity. You agree to indemnify us against any claims resulting from content you submit.
Buyer Responsibilities
Buyers must conduct due diligence before completing a purchase. This includes performing a full HPI check on the vehicle’s history, verifying the presence of the V5 logbook, and confirming that the vehicle matches the description provided by the seller. Buyers are responsible for making full payment before collecting the vehicle. If discrepancies are found, the buyer may renegotiate the offer or refuse to complete the transaction.
Buyers who successfully purchase a vehicle via auction or Car For Cash agree to pay Offerupbid the agreed commission immediately after acquiring the vehicle. Failure to do so will result in legal action to recover unpaid fees.
Vehicle Collection and Inspection
On the day your vehicle is scheduled for collection, an inspection agent from the buyer part will evaluate your vehicle to verify that it aligns with the description and condition you provided during the listing process.
If the buyer confirms that the vehicle matches the described condition, the agreed-upon purchase price should remain unchanged and will be transferred to your bank account or provided as cash as soon as possible.
If the inspection reveals discrepancies, the buyer may:
- Offer a revised purchase price;
- Decline to proceed with the transaction.
Should discrepancies be identified, the buyer reserves the right to renegotiate or cancel the transaction. In cases of disputed vehicle conditions, the final decision will rest with the buyer, based on their inspection criteria. If you disagree with a revised offer, you are not obligated to proceed. Should you need further assistance, you may contact us via the details provided in these Terms.
Security Checks and Fraud Prevention
We take fraud prevention seriously and reserve the right to:
- Conduct checks on vehicles listed for sale;
- Report suspected fraudulent activity to law enforcement authorities;
- Suspend accounts engaged in fraudulent or suspicious activities.
If a transaction is flagged for security concerns, additional verification may be required before proceeding.
Offerupbid as a Marketplace
Offerupbid.uk operates as a marketplace connecting vehicle sellers with car buying partners, which include:
- Car dealers purchasing vehicles via online sales through our nationwide dealer network, subject to eligibility based on make, model, age, and mileage.
- Other car buying partners who engage through a traditional sales process when vehicles do not meet eligibility criteria for daily online sales.
When you sell your vehicle through our Website, the sale is conducted between you and the buyer, and not Offerupbid. At no point does Offerupbid purchase vehicles directly or assume ownership, risk, or liability for transactions made through the Website.
Offerupbid as a Mediator
Offerupbid acts solely as a facilitator between buyers and sellers. We do not own or take possession of any vehicles listed on our platform. While we ensure compliance with UK legal standards, we do not provide guarantees regarding vehicle conditions or transaction outcomes.
If a seller withholds key information about a vehicle, the buyer has the right to withdraw their offer without penalty. Likewise, if a buyer fails to meet their obligations, including completing the transaction within the agreed timeframe, Offerupbid reserves the right to restrict their access to future transactions.
Payment and Commission Recovery
Buyers agree to pay the Offerupbid commission immediately after taking possession of the vehicle. If a buyer fails to do so, Offerupbid will pursue legal recovery of the unpaid fees through court action, in accordance with UK law. Details on the legal enforcement of monetary claims can be found here: GOV.UK Court Claims.
Sellers are not required to pay a commission to Offerupbid, but they must ensure their vehicle is accurately described to avoid potential disputes.
Dispute Resolution
Any disputes regarding vehicle sales, condition discrepancies, or payment issues must be resolved directly between the buyer and seller. Offerupbid is not responsible for settling these disputes. However, we reserve the right to restrict access to our platform for users who repeatedly engage in disputes or fail to comply with our policies.
Intellectual Property Rights
All content on our Website, including text, graphics, logos, and software, is either owned by or licensed to us. You may not reproduce, distribute, or modify any content without prior written consent.
Limitation of Liability
We are not responsible for any losses or damages arising from:
- Misrepresentation of vehicle details by sellers;
- Buyer disputes regarding ownership, payment, or vehicle condition;
- Technical errors or Website downtime beyond our control.
Nothing in these Terms excludes liability for death, personal injury caused by negligence, or fraudulent misrepresentation.
Governing Law and Legal Compliance
These Terms are governed by English law, and any disputes shall be resolved under the jurisdiction of the courts of England and Wales.
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in effect.
Both buyers and sellers must comply with all relevant UK laws when using our platform. Offerupbid will report any fraudulent activity or unlawful behavior to the appropriate authorities. Users who violate these terms may have their accounts suspended or be subject to legal action.
Termination of Use
We reserve the right to terminate or restrict your access to our Website if we determine that you have violated these Terms.
Final Provisions
By using our Website, you confirm that you understand and agree to these Terms, including any future amendments posted on the Website. Offerupbid reserves the right to update these Terms at any time, and it is the responsibility of users to review them periodically.
